Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Immersivimobile application and related websites (the "Service") operated by CodeBay("we", "us", or "our"). By using the Service, you agree to these Terms.

The Service

Immersivi helps you create immersive property videos from listing photos and related project inputs. Features may change over time as we improve the product.

Eligibility and accounts

You must be able to form a binding contract to use the Service. You are responsible for activity under your account and for keeping your credentials secure. Sign-in may be provided through Apple, Google, or other identity providers we support.

Your content

You retain ownership of photos and other content you upload ("User Content"). You grant us a limited license to host, process, transform, and display User Content solely to operate and improve the Service and deliver the outputs you request. You represent that you have the rights needed to upload User Content and that it does not infringe others' rights or violate law.

Generated outputs

Subject to these Terms and your subscription plan, you may use videos and other outputs generated for your projects for your legitimate business or personal purposes. Outputs may vary; AI-generated media is not guaranteed to be accurate, complete, or free of artifacts.

Subscriptions and purchases

• Paid plans, credits, and in-app purchases are billed through the App Store (Apple) unless we state otherwise.
• Pricing, plan limits, and renewal terms are shown in the app and/or App Store listing at the time of purchase.
• Manage, cancel, or request refunds for Apple purchases through your Apple ID / App Store settings and Apple's refund process.

Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, or deceptive purposes
• Upload content you do not have rights to, or content that violates privacy or intellectual-property rights
• Attempt to reverse engineer, disrupt, or abuse the Service or its infrastructure
• Resell or misuse access in ways that violate plan limits

Intellectual property

The Service, branding, software, and related materials are owned by CodeBay or our licensors. These Terms do not transfer ownership of our intellectual property to you.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODEBAY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

Termination

We may suspend or terminate access if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time and delete your account by contacting Support.

Changes

We may update these Terms by posting a revised version on this page. Continued use after changes become effective constitutes acceptance of the updated Terms.
